Terms of Use

JUN Co. Ltd. (hereinafter “JUN”) stipulates the terms of use (hereinafter “these Terms”) for the service provided through its website (hereinafter “this Service”) as follows. Persons who use this Service thereby accept the following conditions.

Section 1: General Provisions

Paragraph 1: Scope of Terms and Alterations Therein

  1. These Terms shall apply to JUN and any users of this Service (hereinafter “User”) including JUN members (as defined in Paragraph 3) with regard to the use of this Service.
  2. The User agrees that JUN may alter these Terms without obaining the prior consent of the User. JUN shall notify the User of such alterations by any method determined by JUN to be appropriate.

Paragraph 2: Use of Service

  1. In using this Service, the User shall comply with these Terms and with any rules, etc., set forth separately by JUN.
  2. JUN may, without obtaining the prior consent of the User, alter the content of this Service.
  3. The User shall be held fully responsible for all information transmitted by the User through this Service, and shall not cause any damage, loss or nuisance whatsoever to JUN.
  4. In the event that a User causes loss or damage to any other User, third party or rights holder in connection with the use of this Service, or in the event that a dispute arises between the User and any other User, third party or rights holder in connection with the use of this Service, the aforementioned User shall be held fully responsible for resolving the matter, shall be held liable for all related costs, and shall not cause any damage, loss or nuisance whatsoever to JUN.
  5. In the case that the User is a minor, the approval of a person with parental authority shall be required for use of this Service.
  6. The Privacy Policy shall be relied upon with regard to matters concerning the User’s privacy.

Section 2: Membership

Paragraph 3: Membership

A ”member” is defined as a person who, upon agreeing to these Terms, has applied for membership registration according to the procedures prescribed by JUN, and has received approval of the application from JUN.

Paragraph 4: Membership Registration

  1. Any person wishing to become a member shall apply for membership by the method specified by JUN at the membership registration page for this Service.
  2. The membership applicant shall enter true and accurate self-reported data on the membership registration form and transmit it to the website. The membership applicant shall not make any false report whatsoever.
  3. In the case of credit card registration, the credit card must bear the name of the applicant.
  4. By transmitting a registration confirmation e-mail message in response to Item 1 above, JUN approves the application.
  5. JUN may refuse to approve any application to which any one of the following circumstances apply: ・Cases in which the membership applicant is found to have been subject to past membership revocation due to violation of these Terms, etc.;

    Cases in which falsified items are included in the content of the membership applicant’s application;

    Cases in which JUN determines that approval of the application would be inappropriate.

Paragraph 5: Notification of Changes

In the event that changes occur in the member’s address, name, telephone number or other information reported to JUN, JUN shall promptly be notified of the changes by the method separately indicated by JUN.

Paragraph 6: Suspension of Service Use and Membership Cancellation

JUN may, without prior notice to the member, suspend the use of this Service by, and may revoke the membership registration of, any member determined by JUN to be unsuitable for membership on grounds such as violation of these Terms, including:

  1. Cases in which the member is found to have been subject to past membership revocation due to violation of these Terms, etc.;
  2. Cases of delay in the performance of an obligation to pay fees etc. related to this Service, or of nonperformance of any other obligations;
  3. Cases in which actions descried in Section 10 (Prohibitions) occur;
  4. Any other cases of violation of these Terms.

Paragraph 7: ID and Password Management

  1. The member shall bear responsibility for management of the member’s self-selected User ID and password.
  2. The member shall not assign, lend or disclose the User ID or password to a third party.
  3. The member shall be held personally responsible for any loss or damage resulting from User ID or password mismanagement, erroneous use or use by any third party.
  4. In the event that the member discovers improper use by a third party of a User ID or password, the member shall contact JUN immediately.
  5. The User acknowledges the danger of information leakage associated with payment methods used with the Service, such as the transmission of credit card numbers, and shall assume personal responsibility for performing these acts (as noted in Paragraph 13).

Paragraph 8: Use of User Information

JUN shall not disclose or provide to any third party information concerning any Users, including members, obtained in connection with the use of this Service, except under the following circumstances:

  1. The User has consented to the disclosure of the User’s own name, address, gender, age, e-mail address, etc;
  2. JUN provides a third party with statistics compiled from personal information for the purpose of understanding utilization trends in a form from which personal information pertaining to particular individuals cannot be identified;
  3. Cases in which doing so is necessary in order to operate this Service.

Section 3: Use of Service

Paragraph 9: Scope of Service

  1. The User shall be authorized to access various services provided as the Service, and some services shall be inaccessible to Users other than members.
  2. The scope of service access shall be specified separately.
  3. JUN may alter the scope of service access without notifying the User in advance.

Paragraph 10: Prohibitions

In using this Service, the User may not:

  1. Make an application using false registration content;
  2. Interfere with the operation of this Service or otherwise engage in acts that could result in obstruction of this Service;
  3. Improperly employ credit cards;
  4. Improperly employ user ID or passwords;
  5. Cause, or engage in acts that could result in, nuisance, disadvantage, loss or damage to any other User, third party or JUN;
  6. Infringe upon, or engage in acts that could result in infringement upon, any copyright, privacy or other rights of any other User, third party or JUN;
  7. Act to the detriment of public order and standards of decency or otherwise in violation of laws or regulations, or engage in acts that could result in such detriment or violation;
  8. Falsely manipulate information regarding JUN or this Service or information provided through this Service;
  9. Transmit or enter any harmful computer program, etc.;
  10. Any other acts determined by JUN to be inappropriate.

Paragraph 11: Copyright

  1. The User may not use any information provided through this Service without obtaining permission from the rights holder unless doing so is within the scope of limitations to right of personal reproduction for private purposes stipulated under copyright law.
  2. In the event that problems arise from a violation of the terms of this paragraph, the User shall be held fully responsible for resolving the matter, shall be held liable for all related costs, and shall not cause any damage, loss or nuisance whatsoever to JUN.

Section 4: Merchandise Sales Service

Paragraph 12: Merchandise Purchasing

  1. Members may use this Service to purchase merchandise from JUN.
  2. When a member wishes to purchase merchandise, the member shall apply by the method specified by JUN. JUN shall then transmit an e-mail addressed to the member stating its assent, whereupon the member and JUN shall enter into an agreement of purchase and sale of the aforementioned merchandise, except in the event that contact is made by the issuer of the credit card specified by the member with notification of nonpayment.
  3. Notwithstanding the provisions stipulated above, JUN shall reserve the right to cancel or terminate any agreement of purchase and sale, or to take any other appropriate measures, in the event of misconduct or inappropriate action related to this Service.
  4. Shipments associated with this Service are limited to personal residence addresses within Japan, and shipments cannot be made to business addresses such as retail stores.

Paragraph 13: Payment Methods

  1. The amount to be paid for merchandise etc. comprises a total of the merchandise purchase price including consumption tax, shipping costs, cash-on-delivery processing fees, etc.
  2. Payments for merchandise etc. purchased through this Service shall be made with credit cards bearing the name of the User, or other payment methods acknowledged separately by JUN.
  3. Payments by credit card shall comply with the provisions of agreements entered into separately by the User and the issuing credit card company. In the event that a dispute arises between the User and the issuing credit card company, the matter shall be settled between these two parties.

Paragraph 14: Merchandise Returns

  1. Merchandise returns are limited to cases of damage incurred during shipment, defective merchandise, erroneous merchandise shipment or other cases acknowledged separately by JUN.
  2. Merchandise returns stipulated in this paragraph, and the associated merchandise exchanges, or termination of agreements of purchase and sale in cases where exchange is impossible, shall be performed within ten days of receipt of the merchandise by the member.
  3. Members shall perform the merchandise returns stipulated in this paragraph in accordance with methods to be specified separately by JUN.

Paragraph 15: Disclaimers, etc.

  1. JUN assumes no responsibility whatsoever for any loss or damage resulting from an inability of a member to use this Service.
  2. The member shall be held fully responsible for all information transmitted by the member through this Service, and JUN shall bear no responsibility therefore.
  3. JUN shall conduct business operations in accordance with the member’s registration content. Regarding disruptions arising from unclear shipping addresses, etc., JUN shall ship merchandise to delivery addresses indicated during the purchase, and shall be exempted from liability by making contact at the point of contact registered by the member.
  4. In the event that the use of this Service by the member results in loss or damage to any third party or results in a dispute with any third party, the aforementioned member shall be held fully responsible for resolving the matter, and JUN shall bear no responsibility therefore.
  5. The member hereby agrees in advance that JUN may alter these rules without obtaining the prior consent of the member, and that notification of the member of such changes by any method determined by JUN to be appropriate constitutes sufficient notification.
  6. Minors may not use the Service without the prior approval of a person with parental authority.
  7. In the case of credit card registration, only a credit card bearing the name of the applicant may be used.
  8. As a general rule, the default method by which JUN and the User communicate shall be e-mail.
  9. In the event that the need for court action arises in connection with the use of this Service, the Tokyo District Court shall be the court of first instance and have exclusive jurisdiction.

Section 5: Operation of Service

Paragraph 16: Information Management

In the event that JUN determines that comment or other information may be used after having been transmitted by the User with consent to its use by JUN, the use of such information within the Service shall be permitted without notice to the User. The deletion of such information shall be permitted without notice to the User in cases to which any one of the following circumstances apply:

  1. The information in question clearly infringes upon the copyright of JUN or a third party, or upon any other rights, or is recognized as being clearly defamatory or damaging to the credit of JUN or a third party;
  2. JUN has received a warning from a third party that the information in question infringes upon the copyright of, or is defamatory to, or is damaging to the credit of, a third party;
  3. A violation of laws or regulations of Japan or another applicable country is recognized as clearly having occurred;
  4. Instructions to delete have been received from government or other public administrative offices.

Paragraph 17: Maintenance of Service

In order to maintain this Service in good operating condition, JUN may, under any of the following conditions, alter, supplement, suspend or cease providing this Service in whole or in part without providing prior notice to or obtaining the prior consent of the User:

  1. Regular or emergency system maintenance;
  2. Difficulties with system operation due to fire, electrical outage, obstruction or damage caused by a third party, etc.;
  3. Other circumstances determined by JUN to require unavoidable system suspension. JUN shall, in principle, bear no responsibility whatsoever for any loss or damage to the User resulting from such stoppage, alteration, etc. of this Service.

Paragraph 18: Other Disclaimers

  1. JUN assumes no responsibility whatsoever for any loss or damage resulting from an inability of the User to use this Service.
  2. JUN shall be exempted from liability in the conduct of business operations in accordance with the User’s registration content.
  3. In the event that the use of this Service by the User results in damage or loss to any other User or to any third party, the aforementioned User shall be held fully responsible for resolving the matter, shall be held liable for all related costs, and shall not cause any damage, loss or nuisance whatsoever to JUN.
  4. Regarding disruptions arising from unclear shipping addresses, etc., JUN shall be exempted from liability by making contact at the point of contact registered by the member, and in shipping merchandise to the delivery address indicated during the purchase.

Paragraph 19: Other

  1. The default method by which JUN and the User communicate shall, in principle, be e-mail.
  2. In the event that a problem arises in connection with the use of this Service which cannot be resolved through these Terms or through instructions from JUN, JUN and the User shall resolve the matter through discussions conducted in mutual good faith.
  3. In the event that the need for court action arises in connection with the use of this Service, the Tokyo District Court shall be the court of first instance and have exclusive jurisdiction.
